Better Things Platform – Terms and Conditions for Service Providers

1. Agreement to Terms
By listing any session on the Better Things platform (“Platform”), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, you are not permitted to offer services on the Platform.
2. Relationship and Responsibilities
2.1 Independent Contractor: You acknowledge that you are an independent contractor and not an employee, agent, or partner of the Platform. You are solely responsible for the provision of your services, including compliance with applicable laws, regulations, and safety standards.
2.2 Service Listings: You agree to provide accurate, complete, and updated information for each session listed, including but not limited to:
- Description of the service.
- Date, time, and location.
- Pricing and availability.
- Participant requirements (e.g., age, skill level).
2.3 Approvals and Changes: The Platform reserves the right to approve, reject, or remove any service listing at its sole discretion. You are responsible for notifying participants and the Platform promptly of any changes or cancellations.
3. Fees and Payments
3.1 Platform Fees: You agree to pay either a platform fee or a subscription fee for the use of the Platform. The applicable fee structure will be communicated to you and may be updated from time to time.
3.2 Payouts: Payments for services rendered will be processed through the Platform, minus applicable fees. The timing and method of payouts will be determined by the Platform.
3.3 Refunds and Disputes: The Platform retains discretion over refund requests and dispute resolution between service providers and participants.
4. Liability and Indemnification
4.1 Limitation of Liability: The Platform is not liable for any loss, injury, damage, or dispute arising from your services, actions, or omissions. You acknowledge that you provide services at your own risk and assume full responsibility for any outcomes related to your sessions.
4.2 Indemnification: You agree to indemnify and hold harmless Better Things, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from:
- Your breach of these Terms.
- Your provision of services, including but not limited to personal injury, property damage, and legal violations.
- Any disputes with participants or third parties related to your services.
5. Use of Media and Intellectual Property
5.1 Consent for Media Use: The Platform will seek your consent before capturing any photos or videos during your sessions for marketing purposes.
5.2 Ownership of Media: All intellectual property rights for photos and videos taken by the Platform belong exclusively to Better Things. You may use such media only with the Platform’s prior written consent.
6. Data Protection and Privacy
6.1 Compliance: You agree to handle participants’ personal data in compliance with applicable data protection laws.
6.2 Confidentiality: You must not disclose any confidential information obtained through the Platform, except as required to provide your services.
7. Termination and Suspension
The Platform may suspend or terminate your access at any time if you violate these Terms or engage in conduct that harms the Platform, its users, or its reputation.
8. Dispute Resolution and Legal Jurisdiction
8.1 Governing Law: These Terms are governed by the laws of Singapore.
8.2 Arbitration: Any disputes arising from these Terms or your use of the Platform will be resolved through binding arbitration in Singapore.
9. Changes to Terms
Better Things reserves the right to modify these Terms at any time. Continued use of the Platform after any modifications constitutes your acceptance of the revised Terms.
